I. Legal basis

• Decree No.96/2016/ND-CP stipulating security and order conditions for a number of conditional business investment lines.
• Decree No. 58/2026/ND-CP dated August 13,2016, amending and supplementing a number of articles of decrees related to security and order conditions for certain conditional business investment lines; management and use of seals; management and use of firecrackers; and detailing a number of articles and implementation measures for the Law on Residence and the Law on Identification.
• Decision No.1523/QD-BCA-C06 announcing newly promulgated, amended, supplemented, and abolished administrative procedures in the fields of management of conditional business investment lines regarding security and order; seal management; firecracker management, residence management; and identification management under the settlement jurisdiction of the Ministry of Public Security.

II. General security and order conditions applicable to all business lines

• The business establishment must be registered, licensed, or established in accordance with Vietnamese law.

• Satisfying all fire prevention and fighting safety conditions as prescribed by the law on fire prevention and fighting.

• The person responsible for the security and order of the business establishment must not fall into the following cases:

  • For Vietnamese citizens: Being subject to criminal prosecution or provisional emergency measures under Vietnamese law.

  • For overseas Vietnamese and foreigners: Not yet being granted a residence permit in Vietnam.

III. Application dossier for the certificate of satisfaction of security and order conditions

Pursuant to Article 19 of Decree 96/2016/ND-CP, the dossier includes:

• A written application for the issuance of the Certificate of Satisfaction of Security and Order Conditions of the business establishment (Form No. 03 in Appendix I issued together with Decree No. 58/2026/ND-CP).

• A valid copy of one of the documents evidencing the business lines of the establishment, such as: Investment Registration Certificate; Enterprise Registration Certificate; etc.

• Valid documents proving the assurance of fire prevention and fighting safety conditions for the business area and materials/goods storage facilities, including:

  • Written approval of fire prevention and fighting acceptance test results.

  • Inspection record on fire prevention and fighting.

  • Other documents depending on the specific business lines of the establishment.

• Criminal record certificate or Personal declaration of the person responsible for the security and order of the business establishment (Form No. 02b issued together with Decree No. 96/2016/ND-CP).

• Other specific documents required for certain conditional business lines.

IV. Procedures for the initial issuance of the certificate of satisfaction of security and order conditions

Pursuant to Article 23 of Decree 96/2016/ND-CP, the procedure is carried out as follows:

• Step 1: Dossier Preparation

• Step 2: Dossier Submission

  • Submission methods: In-person, via postal service, or via the National Public Service Portal.

  • Competent authority: Police Department for Administrative Management of Social Order – Ministry of Public Security.

• Step 3: Dossier Receipt and Validity Check

  • If the dossier is valid and complete, the receiving officer shall accept it and send a Receipt directly, via postal service, via the National Public Service Portal, or via the National Electronic Identification App (VNeID) to the contact person.

  • If the dossier is incomplete or invalid, the officer shall provide guidance and send a Request for Dossier Completion directly, via postal service, via the National Public Service Portal, or via VNeID to the contact person.

  • If the dossier is ineligible or falls outside the jurisdiction, the officer shall refuse it and send a Notification of Refusal stating the reasons directly, via postal service, via the National Public Service Portal, or via VNeID to the contact person.

• Step 4: Issuance The competent authority issues the Certificate of Satisfaction of Security and Order Conditions.

  • Processing time: 4 working days.

  • Validity period: Depends on the specific business lines and other operational licenses of the business establishment.

  • Fee (if any): 300,000 VND (Three hundred thousand Vietnamese Dongs).
