The procedures for obtaining a construction permit for industrial park infrastructure in 2026

I. LEGAL BASIS

  • The Law on Construction 2025;
  • Decree No. 217/2026/ND-CP detailing a number of articles of the Law on Construction regarding the management of construction activities.

II. CONDITIONS FOR GRANTING A NEW CONSTRUCTION PERMIT FOR INDUSTRIAL PARK INFRASTRUCTURE

Pursuant to Article 50 of Decree No. 217/2026/ND-CP, the conditions for obtaining a new construction permit include:

  • The construction must be consistent with the land use purpose in accordance with the law on land, as determined in the lawful land-related documents;
  • The construction design included in the application dossier for the construction permit must comply with the requirements prescribed by law;
  • The construction must ensure the safety of its load-bearing structure, neighboring structures, and satisfy requirements on environmental protection, fire prevention and firefighting; ensure the safety of technical infrastructure and protection corridors for irrigation works, dykes, energy facilities, transportation infrastructure, historical and cultural relics, scenic spots, world heritage sites, cultural landscapes associated with relics, and related cultural spaces; ensure safe distances from structures containing flammable, explosive or toxic substances and structures of importance to national defense and security. For cultural works, the construction must comply with the conditions for issuance of construction permits prescribed by the law on cultural heritage;
  • The construction design must have been prepared, appraised and approved in accordance with the Law on Construction 2025 and this Decree; and
  • The application dossier for the construction permit must be appropriate to the type of construction work, as prescribed in Article 57 of this Decree.

III. APPLICATION DOSSIER FOR A NEW CONSTRUCTION PERMIT

Pursuant to Article 57 of Decree No. 217/2026/ND-CP, the application dossier applicable to linear construction works and non-linear construction works includes:

  • An application for a construction permit, made according to Form No. 01 of Appendix II promulgated together with this Decree;
  • One of the lawful land-related documents serving as a basis for issuance of a construction permit as prescribed in Article 55 of this Decree, or a written approval issued by a competent authority regarding the location and route plan, or a land recovery decision issued by a competent authority in accordance with the law on land;
  • The decision approving the project; the report on the results of construction design appraisal in accordance with this Decree (if applicable); the results of administrative procedures carried out in accordance with the law on fire prevention, firefighting and rescue with respect to the design dossier submitted for the construction permit (if required); the results of administrative procedures concerning environmental protection in accordance with the law on environmental protection (if required); and the written opinion of the provincial-level specialized cultural authority (if required);
  • A set of construction design drawings included in the post-project-approval construction design dossier, or construction drawing design for projects that are only required to prepare an Economic-Technical Report, which has been approved or stamped for certification in accordance with the law on construction, including:
    • the overall site plan of the entire project;
    • the site location plan of the construction work within the land plot;
    • architectural drawings of the floor plans, principal elevations and principal sections of the construction work (for non-linear construction works); or the route location diagram, overall plan or planimetric drawing of the construction work, and principal longitudinal and cross-sectional drawings of the route (for linear construction works);
    • foundation plans and sections;
    • drawings showing the principal structural solutions of the construction work; and
    • drawings showing the connection of the construction work or project to external technical infrastructure systems.

IV. PROCEDURES FOR OBTAINING A NEW CONSTRUCTION PERMIT

Pursuant to Article 54 of Decree No. 217/2026/ND-CP, the procedures for obtaining a construction permit are as follows:

  • Step 1: Preparation of the application dossier

The investor prepares the application dossier in accordance with the applicable legal requirements.

  • Step 2: Submission of the application dossier and payment of the applicable fee

– The application dossier may be submitted online via the National Public Service Portal.

–  In the event of an objective and unforeseen incident preventing submission through the electronic system, the organization or individual may submit the dossier directly at the One-Stop Service Division or via public postal services.

– Competent authority: The Industrial Park Management Board is competent to grant construction permits for construction works invested in and constructed within industrial parks.

  • Step 3: Examination of the application dossier

The competent authority shall examine the application dossier and issue a notice of receipt where the dossier satisfies the applicable requirements or provide instructions for the applicant to supplement and complete the dossier where the dossier fails to satisfy the requirements prescribed in Article 45 of the Law on Construction 2025.

  • Step 4: Grant of the new construction permit

–  Processing time: Within 10 working days from the date on which a complete and valid application dossier is received.
