I. Legal Basis

  • Law on Enterprises 2020;

  • Decree No. 24/2012/ND-CP on the management of gold business activities;

  • Circular No. 34/2025/TT-NHNN providing detailed guidelines on the management of gold business activities, including the production, trading, and import-export of gold in Vietnam.

II. Conditions for Production Activities

Pursuant to Article 5 of Decree No. 24/2012/ND-CP, the conditions for producing gold jewelry and fine arts include:

  • Being an enterprise established in accordance with the law, with the production of gold jewelry and fine arts registered in its Enterprise Registration Certificate.

  • Possessing the location, physical facilities, and necessary equipment to serve the production of gold jewelry and fine arts.

III. Application Dossier for the Certificate of Eligibility to Produce Gold, Silver, and Gemstone Jewelry

Pursuant to Clause 1, Article 3 of Circular No. 34/2025/TT-NHNN, the application dossier comprises:

  • An application form for the Certificate of Eligibility to produce gold jewelry and fine arts, in accordance with the template in Appendix No. 01 promulgated together with this Circular.

  • Documents or materials proving the legal ownership or right to use the production location.

  • A declaration of the physical facilities and necessary equipment serving the production of gold jewelry and fine arts.

IV. Order and Procedures for Issuance of the Certificate of Eligibility to Produce Gold, Silver, and Gemstone Jewelry

Pursuant to Article 13 of Circular No. 34/2025/TT-NHNN, the procedures include the following steps:

  • Step 1: Preparation of the application dossier.

  • Step 2: Submission of the application dossier.

    • To be submitted in person or sent via postal service.

    • Receiving authority: The regional branch of the State Bank where the enterprise’s head office is located.

  • Step 3: Receipt and inspection of the application dossier.

  • Step 4: Physical inspection of the production facility.

    • The competent authority shall organize a physical inspection of the enterprise’s physical facilities and equipment serving the production of gold jewelry and fine arts.

  • Step 5: Review and decision on the issuance or refusal to issue the Certificate.

    • Time limit: 20 days from the date of receipt of a complete and valid dossier.

    • The Director of the regional branch of the State Bank shall decide to issue or refuse to issue the Certificate of Eligibility to produce gold jewelry and fine arts; in case of refusal, the reasons must be clearly stated in writing.

  • Step 6: Issuance of the Certificate of Eligibility to produce gold, silver, and gemstone jewelry.
