Legal basis

  • Law on entry, exit, transit, and residence of foreigners in Vietnam 2014;
  • Circular No. 04/2015/TT-BCA regulations on specimen papers concerning foreigners entering, leaving and residing in Vietnam.

Dossier

Dossier includes:

  • 01 Declaration of request for issuance of a visa-free entry.
  • One of the documents proving that the Vietnamese settled abroad or the documents issued previously used to speculate about the nationality of origin or origin of Vietnam.
  • The guarantee letter of the Association of Vietnamese people residing in the involved country or Vietnamese citizen ensuring that the involved party is a Vietnamese residing abroad (in case there are no documents proving that the Vietnamese settled abroad).
  • Documents proving the relationship between spouses and children with Overseas Vietnamese or Vietnamese citizens (marriage certificates, birth certificates, certificates of paternity, mother, child relationship and other valuable papers as prescribed by Vietnamese law).
  • Foreign passports or persons who have not been issued passports must have permanent residence papers issued by foreign countries (enclosed with copies for the competent authorities to save).
  • In case the above-mentioned papers are not available, the person requesting the visa exemption may present papers issued by a foreign competent authority if it indicates the nationality of origin or origin of Vietnam.

 Number of dossier: 01 (one) set.

Order of implementation

Step 1:

Overseas Vietnamese who request to issue visa-free entry to themselves and their relatives apply at the headquarters of the Immigration Department – Ministry of Public Security

Step 2:

Immigration managers receive dossiers of legal examination and dossier contents:

  • In case the dossier is complete and valid, the receipt shall be printed to be handed over to the applicant.
  • In case the dossier is missing, or invalid, the official receives the guidance dossier for the person to submit the dossier in a timely manner.

Step 3:

Receiving visa-free entry at the Department of Receipt and Return of Results at the Immigration Department – Ministry of Public Security:

Competent authority: At the headquarters of the Immigration Department – Ministry of Public Security

Settlement time: No more than 07 working days from the date of receipt of sufficient dossiers

Results of administrative procedures: visa-free entry.

Requirements and conditions for implementation

  • Foreign passport or foreign passport replacement papers (referred to as passports for short) are valid for at least 6 months from the date of entry. In case Vietnamese people residing abroad do not have passports, they must have permanent residence papers issued by foreign countries valid for at least 6 months from the date of entry.
  • Not to be granted a visa exemption if it is “not allowed to enter Vietnam” in accordance with Vietnamese law.
  • Vietnamese residing abroad and their identity, if they are subject to temporary suspension of exit, are not allowed to issue visa-free entry in Vietnam.
