• Decree No. 96/2016/ND-CP prescribing security and order conditions for certain conditional business sectors;
• Decree No. 56/2023/ND-CP amending and supplementing a number of provisions of Decree No. 96/2016/ND-CP;
• Other relevant legal documents.

CONDITIONS FOR GRANTING THE CERTIFICATE

Organizations and enterprises conducting business in sectors subject to security and order conditions may be granted the Certificate upon satisfying the following conditions:

• Being lawfully established and registered in accordance with Vietnamese law;
• The person responsible for security and order of the business establishment does not fall into any prohibited or restricted cases prescribed by law;
• Satisfying fire prevention and fighting requirements applicable to the business premises, location and relevant areas;
• Satisfying specific security and order requirements applicable to each business sector, including requirements concerning the responsible person, premises, facilities, equipment and other sector-specific conditions, where applicable.

Note: Specific conditions depend on the relevant business sector. Therefore, the exact business sector must be identified to properly assess the conditions for obtaining the Certificate.

REQUIRED DOCUMENTS

The application dossier for the Certificate of Eligibility for Security and Order includes:

• Application form for the Certificate, using Form No. 03 issued together with Decree No. 56/2023/ND-CP;
• Personal background declaration and criminal record certificate of the person responsible for security and order. In the case of an overseas Vietnamese holding a foreign passport or a foreigner, a personnel declaration together with a valid copy of the passport and residence documents is required;
• A valid copy of the legal documents of the business establishment, such as the Enterprise Registration Certificate, Investment Registration Certificate or equivalent document;
• Documents evidencing the business sector, where the business sector to be stated in the Certificate is not indicated in the legal documents of the business establishment;
• A valid copy of documents evidencing compliance with fire prevention and fighting requirements applicable to the business premises and warehouses for storing raw materials and goods, as prescribed;
• Other documents required for the specific business sector, where applicable.

Number of sets: 01 set.

Competent authority: Commune-level Police.

PROCEDURES

Step 1: Prepare and submit the application

The organization or individual prepares 01 set of application documents and submits it to the competent Commune-level Police.

The application may be submitted directly, by post, or online through the relevant public service portal in accordance with applicable regulations.

Step 2: Examination of the application

The receiving officer examines the completeness and validity of the application:

• Complete and valid application: The application is accepted for processing and a receipt is issued;
• Incomplete or invalid application: The applicant is instructed to supplement or complete the application;
• Ineligible application or application falling outside the authority: The application is rejected and the reasons are notified to the applicant.

Step 3: Processing of the application

The competent authority examines and assesses the application and the business establishment’s compliance with security and order requirements.

Step 4: Receipt of the result

Where all requirements are satisfied, the competent authority issues the Certificate of Eligibility for Security and Order.

The result may be received directly, by post, or through the public service portal where electronic results are available.

Processing time: 05 working days from the date of receipt of a complete and valid application.

(This timeframe applies to applications submitted directly, online, or by post.)

Fees: 300,000 VND per application.

Note: The Certificate of Eligibility for Security and Order does not replace other licenses, certificates or sector-specific requirements. The enterprise must continue to fully satisfy fire prevention and fighting requirements and other sector-specific conditions applicable to its business activities.
