Conditions for being granted an automobile import business license
An enterprise established following the law may be granted an automobile import business license when it meets the following conditions:
- Having an automobile warranty and maintenance facility owned by the enterprise, or signed a lease contract by the enterprise, or under the enterprise’s authorized dealer network, meeting the provisions of Decree 116/2017/ND-CP.
- Having a written certification or documents proving that the enterprise is authorized to act on behalf of the foreign automobile manufacturer and assembler to carry out the recall order for imported cars in Vietnam.
The dossiers
- An application form for an automobile import business license (Form 15, Section III, issued together with Decree 17/2020/ND-CP): 01 original;
- Certificate of business registration or paper of equivalent legal value: 01 copy;
- Documents proving that the enterprise meets the conditions for automobile import specified in Article 15 of Decree 116/2017/ND-CP, specifically:
- Documents proving that the enterprise has an automobile warranty and maintenance facility that meets the conditions specified in Decree 116/2017/ND-CP: 01 copy.
- A written certification or document proving that the enterprise is authorized to act on behalf of the foreign automobile manufacturer and assembler to carry out the recall order for imported cars in Vietnam according to the provisions of Clause 2, Article 15 of Decree No. 116. /2017/ND-CP has been approved by the representative agency
Procedures
- Enterprises shall send 01 (one) set of registration dossiers for grant of automobile import business licenses directly or via the postal system or other suitable means to the Ministry of Industry and Trade. The date of receipt of the application is calculated according to the date indicated on the stamp of the incoming dispatch.
- In case the dossier is incomplete or not following regulations, within 07 working days from the date of receipt of the dossier, the Ministry of Industry and Trade shall send a written request to the enterprise to supplement and complete it under regulations.
- Within 10 working days from the date of receipt of a complete and valid dossier, the Ministry of Industry and Trade shall consider granting an automobile import business license to the enterprise (Form No. 15, Section III issued together with Decree 17). 2020/ND-CP).
- In case of necessity, the Ministry of Industry and Trade shall notify the time to check the authenticity of the conditions specified in Article 15 of Decree 116/2017/ND-CP. The inspection period shall not exceed 15 working days from the date of notification. Within 05 working days from the date of inspection results, the Ministry of Industry and Trade shall consider granting the license to import automobiles to the enterprise.
- In case the automobile import business license is not granted to the enterprise, the Ministry of Industry and Trade shall reply in writing and clearly state the reason.
