Legal basis
- Decree 107/2018/ND-CP on rice export business.
Conditions
A trader established and registered for business following the law may trade in rice export when satisfying the following conditions:
- Having at least 01 specialized warehouse for storing paddy and rice following national standards and technical regulations on paddy and rice storage promulgated by a competent authority under Law on standards and technical regulations;
- Having at least 01 mill or rice processing facility under national technical regulations and standards on storage and milling, milling and processing facility promulgated by a competent authority following the Law on Standards and Technical Regulations.
Warehouses, and rice mills may be owned by traders or rented by traders from other organizations or individuals, with written lease contracts under law with a minimum lease term of 5 years.
- Traders with Certificates are not allowed to lease or sublease the warehouses, mills, mills, and rice processing facilities already declared to prove the satisfaction of business conditions in its application for a Certificate, which is used by another trader to apply for a Certificate.
The procedures
- Traders submit dossiers to the Ministry of Industry and Trade.
- The Ministry of Industry and Trade checks the validity and completeness of the dossier;
- If the application is complete and valid, the Ministry of Industry and Trade will verify the content of the application. If the dossier meets all conditions, the Ministry of Industry and Trade shall issue a Certificate of eligibility for rice export business to the trader according to the form specified in Decree No. 107/2018/ND-CP of the Government. In case of refusal to issue a Certificate, within 7 working days from the date of receipt of the dossier, the Ministry of Industry and Trade must reply to the trader in writing, clearly stating the reason.
- The certificate is valid for 5 years from the date of issue. When the Certificate expires, the trader must apply for a new Certificate to continue the rice export business.
The dossier
- An application form for a certificate of eligibility for the rice export business
- Certificate of business registration or Certificate of business registration, Certificate of investment
- Contract to rent a warehouse, mill, and process rice (in case the trader rents a warehouse, mill or processing facility) or papers proving the land use right, ownership rights owning warehouses, milling, milling, and processing establishments (in the case of warehouses, milling, milling and processing establishments owned by traders).
