Procedures for applying for a license to establish a representative office of a foreign cinematographic establishment in Vietnam.

The establishment of a representative office of a foreign film establishment in Vietnam must comply with the provisions of Vietnamese law and must be licensed by the Ministry of Culture, Sports and Tourism. What conditions must a foreign film establishment meet and the application for a license includes what papers and documents are questions of many people.

  • Decree No. 54/2010/ND-CP on detailing several articles of cinematography law
  • Circular no. 11/2011/TT-BVHTTDL on guiding provisions on cinematography-related administrative procedures

Conditions

Pursuant to Clause 1 Art. 12, Decree No. 54/2010/ND-CP:

“1. Conditions for setting up Vietnam-based representative offices of foreign cinematographic establishments:

A foreign cinematographic establishment that wishes to set up its representative office in Vietnam must have operated for at least I year since its establishment or lawful business registration in the country of which it has a nationality.”

The dossiers

  • An application form for setting up a representative office, stating the purpose, tasks, the scope of operation, head office, director of the representative office, and commitment to comply with the provisions of Vietnamese law;
  • A document certifying the legal status of the foreign cinema establishment, issued by a competent foreign agency.
  • Audited financial statement or another equivalent document evidencing the foreign cinematographic establishment’s existence and operation in the latest fiscal year:
  • Copy of the operation charter of the foreign cinematographic establishment.

The above foreign papers are certified by the diplomatic mission or consular office of Vietnam in the country where the cinema establishment applies for its representative office with nationality, and consular legalization is performed following Vietnamese regulations.
