However, to be allowed to legally implement new methods into medical examination and treatment, the medical facility must carry out the procedure to register an addition to the list of professional technical services for traditional medicine clinics in accordance with the law. Fully meeting the conditions regarding facilities, equipment, and professional personnel with appropriate practicing certificates, and strictly following the procedural steps are crucial factors for the clinic to be appraised and approved by the competent authority.

I. Legal Basis

  • Law on Medical Examination and Treatment 2023/QH14
  • Decree 96/2023/ND-CP detailing a number of articles of the Law on Medical Examination and Treatment;
  • Circular 23/2024/TT-BYT on promulgating the list of techniques in medical examination and treatment;
  • Official Dispatch No. 8416/SYT-NVY on consolidating the implementation of dossiers requesting approval of technical lists.

II. Dossier Components

  • Application form for additional technical services – Form 02, Appendix II of Decree 96/2023/ND-CP;
  • The original operating license of the Traditional Medicine Clinic;
  • Declaration of facilities, medical equipment, and personnel records corresponding to the scale or scope of professional activities or the expected technical services to be changed, along with evidentiary documents proving compliance with the changes.

III. Implementation procedure

Step 1: Prepare and submit the dossier

  • Submit 1 set of the dossier and pay the fees/charges to the competent authority where the traditional medicine clinic is headquartered.
  • Receive the dossier receipt slip.
  • Authority: The specialized health agency under the Provincial People’s Committee.

Step 2: Check for validity and Request supplements 

  • The competent authority checks the validity of the dossier.
  • Within 7 working days from the date recorded on the receipt slip, if the dossier is invalid, the licensing authority shall send a written notice specifying the contents that need to be amended or supplemented.
  • Time limit for amendment/supplement: 06 months from the date of issuing the notice.
  • After the first amendment/supplement, if the dossier remains invalid, the applicant shall continue to amend/supplement it for the second time and resubmit.
  • Time limit for the second amendment/supplement: 06 months from the date of receiving the second notice.
  • Note: After 12 months from the date of initial submission, if the supplemented dossier does not meet the requirements, the submitted dossier is no longer valid.

Step 3: Approval decision

  • The competent authority issues a written document allowing the addition or reduction of technical services at the registered facility.
  • Time: Within 20 days from the date of receiving a valid dossier.

Step 4: Appraisal and Approval

  • The competent authority organizes an appraisal at the Clinic registering for additional professional technical services and prepares an appraisal report (if any).
  • Conditions for post-registration appraisal: adding new techniques, etc.
  • The appraisal is conducted on the dossier. In necessary cases, the dossier-receiving agency shall establish a Professional Council to appraise a part or the entire list of techniques at the medical facility.
  • After the appraisal, the dossier-receiving agency submits it for approval and issuance according to its competence.
  • Implementing Agency: The specialized health agency under the Hai Phong City People’s Committee.
  • Processing Time: 35-40 days.
