LEGAL BASIS

  • Decree No. 10/2020/ND-CP dated January 17, 2020, prescribing regulations on road transport business and conditions for road transport business by automobiles;
  • Decree No. 47/2022/ND-CP dated July 19, 2022, amending and supplementing a number of articles of Decree No. 10/2020/ND-CP dated January 17, 2020 of the Government prescribing regulations on road transport business and conditions for road transport business by automobiles.

ENTITIES REQUIRED TO OBTAIN A TRANSPORT BUSINESS LICENSE

  • Enterprises, cooperatives, cooperative unions and business households conducting road transport activities for profit-making purposes.

REQUIRED DOCUMENTS

For transport business enterprises and cooperatives:

  • Application for a Transport Business License according to the form provided in Appendix I to Decree No. 10/2020/ND-CP;
  • Copy of the diploma or certificate of the person directly managing transport operations;
  • Copy or original of the Decision on establishment and regulations on the functions and duties of the department responsible for managing and monitoring road traffic safety conditions (applicable to enterprises and cooperatives engaged in fixed-route passenger transport, passenger transport by bus, taxi passenger transport, container freight transport, and passenger transport using electronic contracts).

For transport business households:

  • Application for a Transport Business License according to the form provided in Appendix I to Decree No. 10/2020/ND-CP;
  • Copy of the Business Registration Certificate.

PROCEDURES

Step 1: Preparation and submission of the application

The transport business entity prepares the required documents and submits 01 set of application to the competent authority.

Step 2: Examination of the application

Within 03 working days from the date of receipt of the application, the licensing authority shall examine the application.

  • If the application is complete and valid: The application is accepted for processing and appraisal;
  • If the application requires amendment or supplementation: The licensing authority shall notify the applicant directly, in writing, or through the online public service system of the documents or contents requiring amendment or supplementation.

Step 3: Appraisal and issuance of the License

Within 05 working days from the date of receipt of a complete and valid application, the competent authority shall appraise the application and issue the Transport Business License for road transport by automobile according to the prescribed form.

If the License is not granted, the competent authority shall respond in writing or notify the applicant through the online public service system, clearly stating the reasons.

Processing time: 05 working days from the date of receipt of a complete and valid application.
