II. CONDITIONS FOR TRADEMARKS
Conditions for trademark specimens:

Must be clearly presented, with dimensions not exceeding 80mm and not less than 8mm.

The overall trademark must be presented within a trademark specimen frame measuring 80mm x 80mm printed on the declaration form.
Conditions for trademark protection:
-
The trademark must be a “visible” sign or a sound sign capable of being represented graphically.
-
The trademark must be distinctive.
III. TRADEMARK REGISTRATION DOSSIER
Pursuant to Article 68 of Circular No. 10/2026/TT-BKHCN, a trademark registration dossier includes:
-
A trademark registration declaration form according to Form No. 04 in Appendix I of this Circular.
-
Attached trademark specimens (05 specimens must be submitted if filing a paper application).
-
A Power of Attorney (if the application is filed through a representative).
-
Receipts of fee and charge payments.
-
Documents proving the right to register the trademark if the applicant acquires the right to register from another person (if any).
-
Documents proving the priority right if claiming priority (if any).
-
Documents proving the right to use an individual’s image for trademark registration (if the trademark contains a personal image).
-
Other supporting documents (if any).
IV. TRADEMARK REGISTRATION PROCEDURE
Step 1: Preparation and submission of the dossier
There are 3 methods of submission:

Direct submission or submission via postal service to the Intellectual Property Office of Vietnam (IP Vietnam) or its representative offices in Ho Chi Minh City and Da Nang.

Online submission via the National Public Service Portal.
Step 2: Reception and formal examination by IP Vietnam

If the application is valid: Publication of the “Decision on acceptance of valid application” in the Industrial Property Official Gazette, within 2 months from the date of the decision.

If the application is invalid: Issuance of a “Notice of refusal to grant a Trademark Registration Certificate” and a 2-month time limit is set for amendment and supplementation.
Step 3: Payment of the substantive examination fee

IP Vietnam conducts a substantive examination and assesses the eligibility for trademark protection.

Time limit: Within 09 months from the publication date of the application or the date of the request for substantive examination.
Step 4: Issuance of the “Decision on granting the Trademark Registration Certificate”
