According to the provisions of Clause 11 Article 2 of the Law on Livestock 2018, a new livestock line or breed is a livestock strain or breed that is first created in the country or imported for the first time into Vietnam. Hong Bang Law would like to provide advice on the procedures for the recognition of new livestock lines and breeds as follows:

Legal basis

• Law on Livestock 2018
• Decree 13/2020/ND-CP dated January 21, 2020, of the Government detailing the Law on Livestock.

The conditions

Article 29 of the Law on Animal Husbandry stipulates the principles of naming new livestock lines and breeds as follows:

• Each new breed and breed can only be given an appropriate name in Vietnamese.
• The naming of new livestock lines and breeds must ensure that they do not fall into the following cases:
  • Duplicating or confusing the name of a recognized livestock breed or breed;
  • Include only numbers;
  • Violating historical, cultural, ethical, and fine traditions of the nation.
  • It coincides with the reading or writing of the name of a leader, national hero, or famous person;
  • Use names of state agencies, people’s armed forces units, names of political organizations, socio-political organizations, socio-political-professional organizations, social organizations, and social organizations – profession, unless approved by that agency, unit, or organization.

The dossiers

• An application form for recognition of a new livestock line or breed, clearly stating the name of the livestock strain, breed, origin, and origin;
• Test results or results of scientific and technological tasks at ministerial or national level which have been recognized or permitted by competent authorities.

• Ministry of Agriculture and Rural Development

The procedures

• Step 1: Organizations and individuals send dossiers to the Ministry of Agriculture and Rural Development (Department of Livestock Production).
• Step 2: Check the content of the application file: Within 03 working days from the date of receipt of the application, the Ministry of Agriculture and Rural Development (Department of Livestock Production) will check. must make a written request to the organization or individual to supplement and complete the dossier;

Within 15 working days after receiving the complete dossier, the Ministry of Agriculture and Rural Development (Department of Livestock Production) shall appraise and evaluate the dossier. If the appraisal and evaluation results are satisfactory, the Minister of Agriculture and Rural Development (the Director of the Department of Livestock Production) shall decide to recognize the new livestock lines and breeds; In case of failure to meet the requirements, the reason must be clearly stated.
