For large-scale farms with 300 or more livestock units, according to the requirements of current law, it is necessary to carry out procedures for granting a certificate of eligibility for livestock production. To help customers understand more about the certificate of eligibility for livestock production for large-scale farm animals, Hong Bang Law would like to advise as follows:
Legal basis
- Law on Livestock 2018
- Decree 13/2020/ND-CP dated January 21, 2020, of the Government detailing the Law on Livestock.
Conditions
Article 55 of the Law on Livestock; Point a Clause 2, Article 21 of Decree No. 13/2020/ND-CP dated January 21, 2020, of the Government detailing the Law on Livestock, the farm must satisfy the following conditions:
- Farm animal husbandry must satisfy the following conditions:

- The location of the farm is suitable for the socio-economic development strategy of the locality and region, the strategy for the development of the livestock industry; meet the requirements on livestock density specified in Clauses 5 and 6, Article 53 of the Law on Livestock.
- Having enough water sources to ensure quality for livestock production and treatment of livestock waste.
- Take measures to protect the environment under the law on environmental protection.
- Having stables and breeding equipment suitable for each type of livestock.
- Having records to record the process of livestock production, use of animal feed, veterinary drugs, vaccines, and other information to ensure traceability; keep records for a minimum period of 01 year after the end of the breeding cycle.
- There is a safe distance from the livestock production area to the subjects affected by livestock production and from the source of pollution to the livestock production area.
- Large-scale farming: From 300 livestocks or more.
The dossiers
- An application form for a Certificate of eligibility for livestock production for large-scale farm animal husbandry (made according to Form No. 01. DKCN Appendix I issued together with Decree No. 13/2020/ND-CP).
- An explanation of livestock production conditions (under Form No. 02. DKCN Appendix I issued together with Decree No. 13/2020/ND-CP dated January 21, 2020, of the Government detailing the Law on Livestock).
The competent authority
- Department of Agriculture and Rural Development
The procedures
- Step 1: Organizations and individuals send their dossiers to the Department of Agriculture and Rural Development.
- Step 2: Check the dossiers:
(1) In case of direct application: At the time of receiving the application, the Department of Agriculture and Rural Development shall check the composition of the application and receive the complete application; In case the dossier is incomplete, the organization or individual shall be returned to supplement and complete the dossier. In case the application is submitted via postal service or through the online environment: Within 03 working days from the date of receipt of the application, the Department of Agriculture and Rural Development shall consider the completeness; In case the dossier is incomplete as prescribed, the Department of Agriculture and Rural Development shall notify the organization or individual to supplement and complete the dossier.
(2) Within 10 working days from the day on which the complete application is received, the competent authority shall appraise the contents of the dossier. In case the dossier is not satisfactory, the competent authority shall request the organization or individual to supplement and complete the dossier. If the dossier is satisfactory, within 20 working days, the competent agency shall set up a team to assess the actual conditions of the livestock production establishment.
- In case the establishment fails to satisfy the conditions, within 06 months from the date of making the assessment record, the organization or individual shall remedy and send a written report on the remedial result to the competent agency for being appraised and re-evaluated actual conditions (if necessary).
- In case the establishment satisfies the conditions, within 05 working days from the date of completion of the assessment of actual conditions, the competent authority shall issue the Certificate of eligibility for livestock production using Form No. 05.DKCN Appendix Appendix I promulgated together with Decree No. 13/2020/ND-CP dated January 21, 2020, of the Government detailing the Law on Livestock; In case of refusal, it must reply in writing and clearly state the reason.
