The procedures for the issuance of new construction practice certificates in 2026

I. LEGAL GROUNDS

  • Law on Construction 2025, taking effect on July 1, 2026.

  • Decree No. 212/2026/ND-CP detailing capacity conditions for construction activities, the Information System, and the National Database on construction activities.

II. WHAT IS A CONSTRUCTION PRACTICE CERTIFICATE?

1. Concept

  • Definition: A construction practice certificate is a declaration of practicing capacity issued to individuals as stipulated in Clause 1, Article 88 of the Law on Construction 2025, who possess adequate professional qualifications and professional experience in their practicing fields.

2. Fields requiring a construction practice certificate

Pursuant to Article 28 of Decree No. 212/2026/ND-CP, the fields for which a construction practice certificate is issued include:

  • Construction survey: Topographic survey; engineering geological survey.

  • Urban and rural planning formulation.

  • Construction design: Architectural design of construction works (implemented in accordance with the law on architecture); structural design of construction works; mechanical-electrical (M&E) design of construction works.

  • Construction supervision: Supervision of construction works; supervision of equipment installation for construction works.

III. CONDITIONS FOR ISSUANCE OF A PRACTICE CERTIFICATE

1. General conditions

Pursuant to Article 33 of Decree No. 212/2026/ND-CP, an individual shall be granted a practice certificate upon satisfying the following general conditions:

  • Having full civil act capacity as prescribed by law; possessing residence documents or a work permit in Vietnam for foreigners and overseas Vietnamese.

  • Having appropriate professional qualifications as prescribed in Appendix I issued herewith. The appropriate professional qualifications shall be determined based on the training major indicated on the diploma. Where the diploma does not specify the training major, the appropriate professional training shall be determined based on the academic transcript or the diploma appendix. The appropriate professional training is confirmed if there is a subject, course project, or graduation thesis suitable for the field and content requested for the practice certificate as prescribed in Appendix I issued herewith.

  • Having professional experience relevant to the class and field requested for the practice certificate within the last 10 years up to the time of application. In cases where the relevant professional experience exceeds 10 years, the applicant may request a practice certificate one class lower at the competent authority as prescribed in Article 31 of this Decree.

  • The duration of experience in participating in work appropriate to the requested content of the practice certificate is classified by class: Class I, Class II, Class III.

2. Conditions on professional experience

Depending on the construction activity field of each individual, they must satisfy different professional experience conditions to be granted a construction practice certificate in various fields according to Articles 34, 35, 36, and 37 of Decree No. 212/2026/ND-CP.

IV. APPLICATION DOSSIER AND IMPLEMENTATION PROCEDURE

1. Application dossier

Pursuant to Article 39 of Decree No. 212/2026/ND-CP, a dossier requesting the first-time issuance of a practice certificate comprises:

  • An application form for the practice certificate (Form 01, Appendix III).

  • A 4×6 cm color portrait photo with a white background of the applicant, taken within the last 06 months.

  • Degrees/diplomas issued by lawful training institutions suitable to the field and class of the requested practice certificate (submitted together with academic transcripts or diploma appendices if the diploma does not specify the major).

  • Decisions on work assignment (task delegation) by the organization for the individual; or a written confirmation from the legal representative of the project investor who bears responsibility for the truthfulness of the confirmed content regarding the work completed by the individual as declared; or a document from specialized construction agencies containing content related to the declared experience of the individual; economic contracts and acceptance minutes of the executed works as declared in the case of independent practitioners.

  • Residence documents or a work permit in Vietnam for foreigners or overseas Vietnamese.

2. Implementation procedure

  • Step 1: Dossier preparation.

  • Step 2: Dossier submission (Submit in person / or by postal service / or online via the National Public Service Portal).

  • Step 3: The competent authority reviews the dossier and initializes an identification code on the Construction Information System.

  • Step 4: Return of the results for the issuance of the construction practice certificate: results are returned in electronic format, linked to the construction capacity identification code.
