Circular 05/2014/TT-BCT stipulating activities of temporary import, re-export, temporary export, re-export, re-import, and border-gate transfer of goods

The dossiers

Dossier of application for a permit for temporary import for re-export; temporary export for re-import; transshipment of goods subject to an export ban, export suspension, import ban, or temporary import suspension; goods exported and imported under permits include:

For the case of temporary import for re-export of goods

• An application form for a permit for temporary import for re-export (made according to the form in Appendix IX): 1 original;
• Certificate of business registration/ Certificate of business registration (or Code of temporary import for re-export in case the enterprise trades in temporary import for re-export of used goods in Appendix V): 1 a copy certified and stamped as a true copy of the original by the enterprise;
• Import contract and export contract signed by the enterprise with foreign customers: 1 copy for each type with certification and stamp of the original copy of the enterprise;
• Report on the implementation of the granted temporary import and re-export permit, certified by the customs authority (according to the form in Appendix X): 1 original.

For cases of temporary import for re-export in other forms

• An application form for a permit for temporary import for re-export (made according to the form in Appendix IX): 1 original;
• Certificate of business registration or Certificate of business registration: 1 copy certified and stamped as a true copy of the trader’s original;
• Lease, loan contract signed with foreign customers: 1 copy certified and stamped as a true copy of the trader’s original;
• Written approval of the Ministries, ministerial-level agencies specialized in the management of the trader’s temporary import for re-export of such goods: 1 copy certified and stamped as true by the trader.

For the case of temporary export and re-import of goods

• An application form for a temporary export and re-import permit (made according to the form in Appendix IX): 1 original;
• Certificate of business registration or Certificate of business registration: 1 copy certified and stamped as a true copy of the trader’s original;
• Contract, agreement on repair and warranty of foreign partners, or contract of leasing or borrowing goods: 1 copy certified and stamped as a true copy of the trader’s original.

For the case of transshipment business

• An application for a license for border-gate trading (made according to the form in Appendix IX): 1 original;
• Certificate of business registration or Certificate of business registration: 1 copy certified and stamped as a true copy of the trader’s original;
• Import contacts and export contracts signed by traders with foreign customers: 1 copy for each type, certified and stamped as a true copy of the trader’s original;
• Report on the implementation of the issued border-gate trading license, certified by the customs authority (according to the form in Appendix X): 1 original.
