Inheritance by will
According to the provisions of law, citizens have the right to make a will to dispose of their property, to leave their property to others. A person’s will is expressed in two forms: a written will and an oral will. For a will to be valid, the following conditions must be met:
- The testator must be in a state of lucidity when making a will; without being deceived, threatened, or coerced
- The content of the will does not violate the prohibition of the law, does not violate social ethics; the form of a will is not contrary to the provisions of the law.
In case there is no witness during the making of the will, the will left behind must comply with the provisions on the content of the will in Article 631 of the Civil Code 2015.
Inheritance by law
Inheritance at law shall be applied when one of the following cases occurs:
- No will
- Illegal will
- There is no longer an heir or an organization or agency entitled to inherit
- The person designated as an heir under the will without the right to inherit or refuse to receive the estate.
