Procedures

Step 1: File for divorce at a competent people’s court;

Step 2: After receiving the lawsuit petition and valid documents, within 05 working days, the court will examine the application and issue a notice of payment of the court fee advance.

Step 3: Pay the first-instance civil court cost advance at the district judgment enforcement sub-department and return the court fee advance receipt to the court.

Step 4: Within 15 days, the court will open a mediation session

Step 5: If the conciliation fails, the divorce will be adjudicated in court;

Application

Profile composition:

• Application for divorce (according to the form of each Court);
• Original Marriage Certificate;
• Certified copy of household registration book of the couple;
• Certified copy of ID card/passport of the couple; Child’s birth certificate (certified copy);
• Other documents and evidence evidencing common property such as: A certified true copy of the certificate of land use rights, ownership of houses and other land-attached assets (red book); vehicle registration; savings book… ask the court to settle.

Deadline for settlement:

• Time limit for trial preparation: 04 months from the date of acceptance of the case. Note, if the case is complicated or there are objective obstacles, the time may be longer.
• Time limit for opening a court session: From 01 to 02 months from the date of issuance of the decision to bring the case to trial.
