Conditions for domestic travel business from 2020

1. Being an enterprise established under the law on enterprises (Is the enterprise registered for travel service business)
2. Deposit for domestic travel service business at a bank. Deposit level for domestic travel service business: 100,000,000 (one hundred million) dong. This is also a new condition of the 2017 Tourism Law for domestic travel business
3. The person in charge of the travel service business must have an intermediate or higher degree in tourism; If you graduate from an intermediate level or higher in another major, you must have a certificate of domestic tourism operations (according to the Circular No. 06/2017 dated December 15, 2017, of the Ministry of Culture, Sports and Tourism, regulations on the degree of a person in charge of domestic travel service business)

An application file for a license to provide domestic travel services includes

1. An application form for a license to provide domestic travel services (according to the form);
2. A certified copy of the Certificate of Business Registration;
3. Certificate of deposit for travel service business;
4. A certified true copy of the appointment decision or the labor contract between the tour operator and the person in charge of the travel service business;
5. Certified copies of diplomas or certificates of the person in charge of travel service business satisfying the requirements.

Procedures to grant licenses for domestic travel service business

• Enterprises applying for a license to provide domestic travel services shall submit 01 set of documents to the specialized tourism agency of the province where the enterprise is located (the Department of Tourism or the Department of Culture, Sports and Tourism.);
• Within 10 days from the date of receiving the valid dossier, the Department of Tourism or the Department of Culture, Sports and Tourism of the province shall evaluate and grant a license to provide domestic travel services to the enterprise; In case of refusal, it must be notified in writing and clearly state the reasons therefor.

Rights and obligations of domestic tour operators

• Develop, advertise, sell and organize the implementation of tourism services and travel programs for tourists according to the business scope specified in the license;
• Ensuring the maintenance of conditions for business travel services as prescribed; publicize the name of the enterprise, the license number of the travel service business on the signboard at the head office, branch, transaction office, in the travel contract, in the advertising publications, and electronic transactions;
• Notify the change of the person in charge of the travel service business, send the dossier of the person in charge of the travel service business instead to the Department of Tourism within 15 days from the date of change;
• Provide information about tourist programs, services, and destinations for tourists;
• Buy insurance for tourists during the implementation of the travel program, unless the tourist already has insurance for the entire travel program;
• Using tour guides to guide tourists under travel contracts; take responsibility for the tour guide’s activities during the time of guiding tourists under the contract;
• Obey, disseminate and guide tourists to comply with the laws and regulations of the tourist destination; behave in a civilized manner, respecting the cultural identity, customs, and practices of Vietnam and the tourist destination; coordinate with competent state agencies to promptly handle violations of law by tourists during their participation in the tour program;
• Implement reporting, statistical, accounting, and record-keeping regimes following the law;
• Apply measures to ensure the safety of life, health, and property of tourists; promptly notify competent state agencies of accidents and risks occurring to tourists and take remedial measures;
• Manage tourists according to the tour program agreed with tourists.
