Legal basis

• Consulting on conditions to be granted a foreign contractor license in Vietnam;
• Consulting and drafting contracts between foreign contractors and Vietnamese contractors;
• Drafting documents to apply for a construction contractor’s license for foreign contractors;
• Translate, notarize, translate and consular legalize documents in service of the issuance of foreign contractor licenses in Vietnam;
• Representing the customer to apply for a contractor’s license at the Ministry of Construction/Department of Construction;
• Follow up the processing of the case;
• Representing the Client to obtain the contractor’s license at a state agency;

Document to be provided

• The contractor’s business registration certificate (Consular legalization);
• Report of experience related to the projects the contractor has implemented within the last 3 years (Hong Bang Law supports to provide a sample document);
• Audit report within the last 3 years (Consular legalization);
• The tender contract between the Investor/main contractor and foreign contractor (translated into Vietnamese and notarized);
• Joint venture contract with Vietnamese contractors or Subcontracting contracts with Vietnamese subcontractors (translated into Vietnamese and notarized);
• Certificate of business registration and Certificate of capacity for construction activities (if any) of the Vietnamese sub-contractor;
• Passport of the legal representative of the Contractor;
• Passport of the Project Director;
• Certificate of business registration of the Investor/main contractor;
• Project’s legal papers: Decision approving project investment policy, Investment registration certificate, other relevant project documents.

The competent authority

• For group A projects, construction investment projects in 02 provinces or more: Procedures are carried out at the Construction Management Department – Ministry of Construction;
• For projects group B, group C: Procedures are carried out at the Department of Construction of the province or city where the project is implemented.

Time 

• The performed time is 20 – 25 working days from the date of receipt of complete and valid dossiers.
